ERA Caputo Realty is a licensed real estate brokerage in New Hyde Park, New York, and an independently owned and operated member of the ERA franchise network. This Privacy Policy governs the collection, use, storage, sharing, and protection of personal information obtained through www.eracaputo.com, lead capture forms, email, SMS/text message communications, open house sign-in processes, IDX-powered property search tools, and all other services operated by ERA Caputo Realty (the “Services”). 1. Information We Collect
1.1 Personal Identification: Name, email, phone, mailing address, property preferences, buyer/seller status, and other information you voluntarily submit via forms or inquiries.
1.2 Property Search / IDX Data: Search criteria, saved searches, favorited listings, browsing history, and session frequency within our IDX portal.
1.3 Communications Data: Emails, SMS messages, chat messages, and call/voicemail records conducted through or with our Services.
1.4 Transaction Data: Property/transaction details, agency disclosures, contract documents, inspection communications, and professional referral information gathered during a real estate transaction.
1.5 Device & Technical Data: IP address, browser type, OS, referring URL, pages visited, time on site, click paths, and cookie/session identifiers collected automatically.
1.6 SMS Consent Data: Mobile phone number, date/time/method of consent, consent language version, and opt-out records.

4. Text Message (SMS) Communications & TCPA Compliance
Caputo Realty Inc. DBA ERA Caputo Realty uses Dialpad to send and receive SMS/MMS messages in compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and CTIA guidelines.
4.1 Consent Requirement: We send text messages only to individuals who provide express written consent via: an eracaputo.com form with a clearly marked SMS consent checkbox; a digital open house sign-in with consent acknowledgment; or an opt-in keyword sent to our business number.
4.2 Consent Language: The following disclosure is presented at point of opt-in:
“By submitting this form and providing your phone number, and by checking the SMS consent box, you consent to receive text messages from Caputo Realty Inc. DBA ERA Caputo Realty regarding real estate services, property listings, appointments, and follow-up communications. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time. Reply HELP for assistance.”
4.3 Message Content: Messages may include property inquiry responses, listing notifications, appointment confirmations, agent follow-ups, and market updates. Standard carrier message and data rates may apply.
4.4 Opt-Out: Reply STOP at any time to unsubscribe. You will receive one confirmation message; no further marketing texts will be sent; your opt-out will be logged. You may also opt out by contacting us per Section 15.
4.5 Help: Reply HELP for assistance or contact us per Section 15.
4.6 Non-Sharing: We do not sell, rent, or share mobile phone numbers or SMS consent data with third parties for their own marketing purposes.
4.7 Not a Condition of Service: SMS consent is not required to engage ERA Caputo Realty real estate services.
4.8 Carrier Disclaimer: Wireless carriers are not liable for delayed or undelivered messages.
4.9 A2P 10DLC Registration: Our business SMS is registered under the A2P 10DLC framework with applicable wireless carriers and campaign registries per CTIA guidelines.
5. Cookies and Tracking Technologies
eracaputo.com uses cookies, web beacons, and tracking pixels to enhance functionality, analyze visitor behavior, and support marketing.

6. IDX / MLS Data and Third-Party Listing Services
6.1 Source: Listing data on eracaputo.com is sourced from the applicable MLS under IDX licensing agreements. MLS data is proprietary to the MLS and participating brokers.
6.2 Search Activity: Your property search activity may be tracked by ERA Caputo Realty and the IDX vendor, and may be reported to the MLS per participation rules.
6.3 Accuracy: ERA Caputo Realty does not warrant the accuracy or completeness of listing data. All properties are subject to prior sale, price change, or withdrawal. Independently verify all listing information before making real estate decisions.
6.4 IDX Vendor: ERA Caputo Realty is not responsible for third-party IDX vendor data practices. Review the applicable vendor’s privacy policy.
6.5 Deletion of IDX Search History: Submit a written request per Section 15 to request deletion of IDX search history records held by ERA Caputo Realty.
7. CRM and Internal Data Management
ERA Caputo Realty uses a real estate CRM (such as MoxiWorks) to manage clienprospect data, including name, email, phone, address, lead source, property preferences, communication history, transaction status, assigned agent, and opt-in/opt-out records. Access is restricted to licensed agents and authorized staff via role-based permissions. Inactive leads with no completed transaction are retained up to two years, then deleted or anonymized. The CRM provider acts as a data processor under applicable data processing agreements.
8. How We Share Your Information
ERA Caputo Realty does not sell, rent, or trade personal information. We share only as described below:
8.1 ERA Franchise Systems, LLC: As an ERA franchise, ERA Franchise Systems may access certain general transaction and performance data per the franchise agreement. ERA Caputo Realty is independently responsible for its own privacy practices.
8.2 MLS and IDX Partners: Certain listing, transaction, and search activity data may be shared with or accessible to the MLS and IDX vendors per participation agreements.
8.3 Technology and Service Providers: We engage third-party vendors who access personal information only to perform services on our behalf, including: CRM provider (e.g., MoxiWorks), IDX technology vendor, website hosting provider, email marketing platform, Dialpad (SMS/voice), Google Analytics/Tag Manager, and Meta Pixel. We execute data processing agreements where applicable.
8.4 Cooperating Brokers and Transaction Professionals: In the ordinary course of a transaction, we may share relevant information with buyer’s agents, seller’s agents, transaction coordinators, and showing service providers.
8.5 Legal and Regulatory Disclosures: We may disclose personal information when required by law, court order, or governmental authority, including the NY Attorney General, NY Department of State, NY Department of Financial Services, FTC, and law enforcement.
8.6 Professional Advisors: With your knowledge and consent where required, we may share relevant information with attorneys, title companies, inspectors, lenders, surveyors, and environmental consultants in your transaction.
ERA Caputo Realty does NOT sell personal information to third parties.
9. Your Privacy Rights (New York Residents)
New York residents have the following rights under the New York SHIELD Act (NY General Business Law Section 899-aa, as amended through December 2024):
9.1 Right to Know: Request the categories and specific pieces of personal information we hold about you and the purposes for which it is used.
9.2 Right to Correction: Request correction of inaccurate or incomplete personal information.
9.3 Right to Deletion: Request deletion of personal information, subject to exceptions for records required by NY real estate licensing law, MLS/IDX rules, active transactions, litigation, or TCPA-required SMS consent records.
9.4 Right to Opt Out of Marketing: Unsubscribe from email marketing via the unsubscribe link; opt out of SMS by replying STOP; opt out of direct mail by written request.
9.5 Right to Opt Out of SMS: Reply STOP at any time. See Section 4.4.
9.6 Right to a Copy: Request a copy of your personal information in a portable format, to the extent technically feasible.
9.7 How to Exercise Rights: Submit a written request per Section 15 with your full name, email or phone associated with your records, and a description of the right you wish to exercise. ERA Caputo Realty will acknowledge within 5 business days and fulfill verified requests within 30 days.
9.8 Non-Discrimination: ERA Caputo Realty will not discriminate against you for exercising any privacy right.
10. Data Security
ERA Caputo Realty maintains a reasonable data security program compliant with the New York SHIELD Act, including:
Administrative Safeguards: Designated security coordinator; employee training; third-party vendor vetting; documented incident response; periodic policy review.
Technical Safeguards: TLS/SSL encrypted transmission; password-protected and role-based access controls; multi-factor authentication (MFA) where available; monitoring for suspicious activity; regular software updates.
Physical Safeguards: Secure office access controls; secure document disposal by shredding; restrictions on unauthorized personnel accessing physical files or devices.
No method of electronic transmission or storage is completely secure. You transmit personal information at your own risk. In the event of a qualifying security breach, ERA Caputo Realty will notify affected New York residents within 30 days of discovery and file required notices with the NY Attorney General, NY Department of State, NY State Police, and NY Department of Financial Services. Security program records are retained for a minimum of 5 years.

12. Children’s Privacy
eracaputo.com and ERA Caputo Realty’s Services are directed exclusively to adults (18+). We do not knowingly collect personal information from minors. If we become aware that a person under 18 has submitted personal information, we will promptly delete it. Parents or guardians who believe a minor has provided personal information should contact us immediately per Section 15.
13. Third-Party Links and Services
eracaputo.com may contain links to third-party websites including mortgage calculators, neighborhood data services, school platforms, the ERA national website, social media, and government property records portals. ERA Caputo Realty does not control, endorse, or monitor third-party websites. When you leave eracaputo.com, this Privacy Policy no longer applies. Review each third-party site’s privacy policy before submitting personal information.
14. Changes to This Privacy Policy
ERA Caputo Realty may update this Privacy Policy at any time to reflect changes in data practices, applicable law, or operations. All changes are effective upon posting unless a different effective date is stated. When we make material changes, we will update the Effective Date and may notify active clients by email or website notice. Your continued use of eracaputo.com after posting constitutes acceptance. A current copy of this Policy is always available at www.eracaputo.com.
